Listing Conditions

Buddying UP is a community friendly ecommerce website providing a safe, fair, trustworthy, respectful and supportive environment.

All listings on our site must adhere to our values and our listing conditions policy. This is to ensure a positive user experience for everyone that uses Buddying UP.

When listing a Product or Service on Buddying UP's website, you agree to pay Buddying UP's fees, assume full responsibility for the content of the listing, and accept the following listing conditions:

• When you list an item on Buddying UP's websites, your listing will be posted on Buddying UP's websites and it can be viewed in Products and Services under 'My Profile'.
• Your listing may not be immediately 'live' or searchable by keyword or category for several hours (or up to 24hrs in some situations).
• We may revise the data in the listing to add, remove or correct information; if your listing uses catalogue data that has been revised, those revisions may modify your listing accordingly.
• Where your listing appears in search and browse results, it may be based on certain factors including listing format, title, keywords, price and postage cost, feedback and seller ratings.
• Your listing will, at all times, comply with Buddying UP rules and policies, including listing rules.
• You must list your item in the most relevant category.

BUP – Listing Rules

At Buddying UP, we do not tolerate listings or advertising for Products and Services that promote any of the following:

• Hatred or violence
• Discrimination
• Harassment
• Illegal behaviours
• Trolling
• Use of profanity, or
• Involve Prohibited Activities or Prohibited Content or Prohibited Products and Services

Sellers offering a Service must hold the relevant current and relevant licences and qualifications:

• Some activities require qualifications and licences and are regulated by national or state authorities. Sellers should familiarise themselves with all qualification and licensing requirements relevant to the services they offer. Sellers must not offer services where a licence is required unless they have that licence.
• Users need to have a close regard for our Terms and Conditions and Advertising Policy and strictly comply with it.

Fake or Fraudulent Reviews

We do not support the following activities within our Buddying UP community, as it jeopardises the creation of a fair, transparent and trustworthy environment:

• Fraudulent reviews
• Fake reviews

Images and Text Policy

To make sure you are giving potential buyers an accurate representation of your items, and that you are not infringing on anyone else's content rights, you should write your own descriptions and use your own images.

Your listings, stores pages, product pages, member communications and images uploaded when you return an item should follow this policy as well as our other policies, including our Terms and Conditions policy and Transaction policy.

Allowed

• Images, videos and text you created yourself, without any third-party content or intellectual property

Restricted or Not Allowed

Unless you have explicit written permission from the respective rights owners to use the content on Buddying UP, you are not allowed to use third-party content, including but not limited to the following:

• Images, videos or text copied from websites or internet searches
• Information from product packaging
  • It is usually OK to use information such as measurements, weight, or other item specifications that are necessary to describe the item that you simply cannot say any other way. However, you should avoid using any other text from product packaging.
• Scans or text copied from catalogues or advertisements
• Poor-quality videos or images that are blurry, undefined or distorted
• Illegal content
  • We never allow any listings that include material or items depicting or describing child pornography, whether real or fictionalised
  • We never allow any listings that include material or items depicting or describing bestiality, torture, snuff films, necrophilia, rape, scat, incest, or other illegal or obscene content, whether real or fictionalised
• Buddying UP never allows listings which include illegal material
• Offensive content that promotes or glorifies hatred, violence or discrimination

Listings that promote, perpetuate or glorify hatred, violence, or discrimination, including on the grounds of race, ethnicity, colour, religion, disability, national origin, sex, gender and gender identity or sexual orientation, are not allowed. This includes but is not limited to the following:

• Slurs or epithets of any kind
• Slavery items, including reproductions, such as tags, shackles, documents, bills of sale, etc.
• Items with racist, anti-Semitic, or otherwise demeaning portrayals, for example through caricatures or other exaggerated features, including figurines, cartoons, housewares, historical advertisements, and golliwogs
• Items that are discriminatory
• Historical Holocaust-related including reproductions
• Any item that is anti-Semitic or any item from after 1933 that bears a swastika
• Media identified as Nazi propaganda
• Listings that imply or promote support of, membership in, or funding of a terrorist organization, gangs.

In order to promote trust and respect among our diverse community of members, Buddying UP does not allow items that promote or glorify racial, sexual orientation or religious intolerance, or promote organizations that hold such views.

• Videos that include nudity or sexually oriented materials are not allowed.

Sexually-oriented adult material is not allowed. This includes the following:

• Films and video games classified as RC (refused classification), X or created for an adult audience
• Sexually explicit anime, comics, books, films, animation, manga, hentai, yaoi
• Adult magazines, nudist publications, or adult anime/manga that include sexually-explicit content, nudity, or sexual stories
  • The following magazines and books can be listed as long as the listing and product don't contain nude images or explicit content: Playboy, Playgirl, Mayfair, and Penthouse

Activity that does not follow Buddying UP policy could result in a range of actions including for example: administratively ending or cancelling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

How Buddying Up protects intellectual property rights

Intellectual property rights owners

Buddying UP is committed to protecting the Intellectual property (IP) rights of all brand products and services on our site.

We do not allow listings that violate the IP rights of brands or other rights owners.

Only intellectual property rights owners can report Buddying UP listings that infringe on their copyright, trademark, or other intellectual property rights. Sellers who are rights owners who have any issues of concerns should contact us: admin@buddyingup.com.au.

Not the rights owner

If you are not the rights owner, who are in jeopardy of sustaining legal action against you. The best thing to do if you are not the original rights owner is to get in touch with the original owner and encouraging them to contact us. This will allow for your products and services to be legally listed on our site.

If a Seller's listing or product was removed

Sellers who believe their listing or product was removed in error, can contact us at admin@buddyingup.com.au.

Why does Buddying UP have this policy?

Like with every reputable business; we expect trust, honesty and integrity of ourselves first and foremost. Therefore, we would hope for nothing less from all our onboarding businesses and community organisations using our marketplace web-site.

If you are unsure or what you can or cannot list on the Buddying UP web-site, please read carefully all relevant information related in our listing conditions policy. If you are still unsure, feel free to contact info@buddyingup.com.au for further clarification.

Sellers must accurately represent the items they are selling. Using content that you do not own could violate laws, rules, regulations, our policies or any third-party rights, including intellectual property rights.

No item listings policy

All listings on buddyingup.com.au have to offer a physical item or a tangible service. Listings that are blank, or do not offer a tangible item or service, are not allowed because they can cause confusion for buyers and increase the risk of fraud.

A listing must offer either a physical item, which includes digitally delivered goods, or a service for sale. Want ads, place holders, or offers to trade are not allowed.

All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

This policy helps keep Buddying UP a safe and enjoyable place to buy and sell, as listings that do not offer an item or service for sale can be confusing for buyers.

Search and browse manipulation policy

Sellers are not allowed to add popular keywords in your listings that do not have any relation to your items which includes:

• Manipulating search results to gain unfair visibility of a listing is not allowed
• Using keywords that are not directly related to the item for sale is not allowed. All the words in the listing need to be accurate and refer only to the item for sale
• If the item is an accessory for or compatible with another item, “fits” “for” or “compatible with” should be stated before the name of the compatible item. However, “fits” “for” or “compatible with” is not allowed before the brand names of jewellery, clothing and accessories, or universally compatible items
• Listings that make comparisons with other products are not allowed
• Listings that promote other listings are not allowed
• Listings can't include keywords with question marks, as this can be misleading for buyers. If any item details are unclear or unknown, they should be left out of the listing
• Offering a choice of different products in a single listing is not allowed. This includes:
  • Selling different brands or models in the same listing (for example, an iPhone 6 and an iPhone 7)
  • Selling different items with different conditions in the same listing (for example, “new” and “used” items)

Item location misrepresentation policy

To make sure buyers have a clear understanding of postage charges and delivery times, all sellers must provide clear and accurate information in their listings about where their item is located.

• Clear and accurate information about where the item is located, including the postcode, city and country from which the item will be sent, must be included in listings
• Item location information must be consistent across all areas of the listing including title, description and item specifics
• A tracking number uploaded after an item has sold must match the dispatch location provided in the listing

All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

This policy helps buyers make informed purchasing decisions based on postage costs and delivery times and protects sellers from complaints about excessive costs or delays.

Warranties Policy

Offering your customers a guarantee or warranty gives them peace of mind when they buy from you, and can help give you an edge on the competition.

If you are including a written warranty or a service contract with an item you're selling, you must include all of the warranty information required under Australian Consumer Law in your listing. For a brief summary of your obligations with regards to warranties, see additional information below.

Make sure your listings and products follow these guidelines. If they do not, they may be removed, and you may be subject to a range of other actions, including limits of your buying and selling privileges and suspension of your account.

Activity that does not follow Buddying Up policy could result in a range of actions including for example: administratively ending or cancelling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

Additional Information

In general, if you sell on Buddying UP as part of a business or professional activity, you must provide consumer guarantees when selling to buyers in Australia. Visit the ACCC website for more information about consumers' rights and your obligations.

You can choose to provide a 'warranty against defects' (i.e. promises about what you will do if something goes wrong with the goods). This is provided in addition to consumer guarantees and does not limit or replace them.

If you offer a warranty against defects, your warranty documents must include certain information, including:

• Information about how to make a claim (how to contact you and where to send the claim)
• Mandatory text to inform buyers that any rights under that warranty are in addition to any other rights they may have under the Australian Consumer Law

Because the sale of warranties is highly regulated, listings and products that contain warranties are restricted. We urge our sellers and buyers to comply with government laws and regulations.

JavaScript Policy

Active content in listings can create a poor experience by increasing page load times and introducing security risks. That's why it's not allowed in listings on Buddying UP.

Active content such as JavaScript, Flash, plug-ins, and form actions are not allowed in the listings. If you include active content in your listings then they may not look as expected and buyer experience may be impaired.

Some forms of active content that can be used maliciously are still not allowed in listings or other Buddying UP pages. You also are not allowed to use JavaScript to manipulate the standard functions of Buddying UP listings, Buddying UP Store pages or your profile. For details on what is and is not allowed on the site, see the guidelines below.

Any attempt to disguise the intention or function of a listing's source code when using JavaScript is a violation of Buddying UP policy. Sellers may not manipulate or edit anything outside of the areas designated for member content.

Make sure your listing follows these guidelines. If it doesn't, it may be removed, and you may be subject to a range of other actions, including limits of your buying and selling privileges and suspension of your account.

All throughout listing ecosystem, Buddying UP does not allow embedded scripts or html code. Regardless of the purpose, Buddying UP will have the right to remove such listing without prior notice.

What are the guidelines?

Not allowed

You cannot use JavaScript that:

• Calls remote scripts and pages automatically
• Changes registry entries or otherwise writes to another person's computer hard drive
• Creates automatic pop-ups except for links that open in a new window when clicked on
• Is used to drop or read a cookie on any Buddying UP page
• Loads any binary program on another person's computer automatically
• Launches a song or video when a listing is opened
• Overwrites any area in the listing outside of the item description area
• Manipulates areas outside the listing description, including changing fonts, colours and backgrounds in areas such as Buddying UP headers and footers
• Posts to scripts on Buddying UP automatically
• Redirects the user from Buddying UP to another web page, such as using the "replace" script.

Additional Information

If you try to use scripts that we disable, you will get an error message that says "Disallowed JavaScript/HTML Syntax". This means you will not be able to list the item, or the script will be disabled at run-time. Any other error message indicates a separate issue and isn't related to disabling HTML or JavaScript code.

To help keep our website working the way we designed it to, we do not allow using scripts that manipulate or change the way the site and its features operate, and we do not render active content.

Links Policy

Buddying UP does not allow listings to contain links direct to customers to a site other than Buddying UP which includes,

• We do not allow store names to be a web address or include (for example) ''.com', ''.net', ''.org' or ''.edu'
• Videos cannot violate any Buddying UP policy, such as adult content or offers to buy or sell outside of Buddying UP, and must be specific to the listing, such as a product review, demonstration or installation video.

Links in a description are only allowed for the following:

• Other Buddying UP pages (Messages, other items, Stores pages, Follow Seller or Add to my Favourite Sellers)
• Product videos
• Freight shipping services approved by Buddying UP
• Legally required information
• Credit for third-party providers

Videos must be embedded within item descriptions and are only allowed from sites on this list

Credits for third-party providers are not allowed to link off- Buddying UP or contain external web addresses or contact information, and must follow these guidelines:

• They may contain up to 10 words of text (HTML font size 3) and a logo no larger than 88 x 33 pixels
• The credit or acknowledgement cannot contain promotional material and should only identify the specific service provided for the listing and should not contain logo or markings of another competing ecommerce.
• They can't flash, move, or be animated

Third-Party Endorsements Policy

To make sure Buyers cannot be misled by endorsements that cannot easily be verified, we do not allow the use of third-party statements or logos that vouch for a seller's 'reputation' or 'trustworthiness' in Buddying UP listings.

Buddying UP doesn't allow third parties to provide logos or statements that claim to vouch for a member's trustworthiness. You can include information in your listing about your Buddying UP reputation, such as your feedback ratings.

However, you cannot make statements about your reputation as a seller in a way that buyers cannot verify. You also cannot include endorsements from other people or companies that talk about your trustworthiness as a seller, because buyers cannot verify those types of claims.

Make sure your listings and Products and Services follow these guidelines. If they do not, they may be removed, and you may be subject to a range of other actions, including limits of your buying and selling privileges and suspension of your account.

What we allow and do not allow

Allowed

• Statements that guarantee the transaction or item, but do not guarantee the seller. Examples include:

  • "Satisfaction guaranteed or your money back."
  • "Protected transaction guaranteed for up to $25,000."

• Statements about seller confidence because a buyer can easily verify this claim. Examples include:

  • "Buy with confidence! I have over 1,000 positive Feedback ratings."

Not Allowed

• Third-party statements, seals or logos that vouch for the trustworthiness of a seller, such as:

  • "This Buddying UP seller is extremely reliable and reputable."
  • "Buy with confidence from a trusted seller."
  • "Reliable seller"
• Statements, seals or logos that manipulate Buddying UP's Feedback system because buyers cannot verify these claims. For example, "100% positive Feedback in authentic watches".

Since we cannot verify the trustworthiness claims made by third parties, we do not allow these claims in listings or products. Manipulating any Buddying UP reputation system, such as Feedback ratings, could confuse or mislead buyers.

Duplicate Listings Policy

Only one fixed price listing of an identical item can be listed at the same time, from the same seller. This is to ensure buyers see a wide variety of options from multiple sellers.

To ensure buyers see a wide variety of options from a variety of sellers, we don't allow more than one fixed price listing of an identical item at the same time from the same seller.

Duplicate Listings Policy

• We do not allow more than one fixed price listing of an identical item at the same time from the same seller. This includes:

  • Listing an identical item in different categories or listing an identical item using different usernames
  • Listings that aren't significantly different, such as adding an inconsequential bonus item with the same identical item in two listings

• Identical auction-style listings are allowed if they:

  • Have the same start price
  • Have the same reserve price
  • Have the same title and description
  • Do not use the Buy It Now option
• Multiple fixed price listings for identical generic or universal items, such as AA batteries for example, are not allowed. Separate listings can be created for the same item on different Buddying UP sites, as long as the international delivery options don't result in the listings cluttering the search results of any individual site
• Up to 5 separate fixed price listings for identical items designed to fit multiple devices are allowed, when each listing is differentiated by spelling out the brand or model the item fits
• Buddying UP bulk listing can be used when there is many of the same item for sale

Activity that does not follow Buddying UP policy could result in a range of actions including for example: administratively ending or cancelling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

This policy ensures buyers see a wide range of options from a greater number of sellers on our site and that no one seller can dominate search results.

Pre-Sale Listings Policy

To ensure buyers are not disappointed, our pre-sale listings policy for items like cell phones and video games outlines the requirements for this type of transaction.

Presale listings must clearly state that they are "presale" in the title and description, and guarantee postage within 20 days of purchase.

In order to protect buyer and seller guarantees, presale listings must follow Buddying UP policy, including listing the date the item will be available to post.

• Presale listings must guarantee that the item will be posted within 20 days of purchase
• The date the item will be available to post must be clearly stated in the listing
• Listings must clearly indicate in the title and description that the item is being offered for presale
• Handling time details should include the time it will take the seller to acquire the item, in addition to the time it will take the seller to deliver the package to the postal carrier

Activity that does not follow Buddying UP policy could result in a range of actions including for example: administratively ending or cancelling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.

Prohibited Products & Services

• Aerosol paint.
• Airsoft/BB guns, paintball guns.
• Alcohol recovery or hangover cures or treatments.
• Anti-radiation products (including electromagnetic field protection and radiation neutralizing or shielding products).
• Coupon sites.
• Escort services, adult dating, sex toys & merchandise.
• Etching creams.
• Fat burners and fat blockers.
• Fertility clinics and research.
• Get-rich-quick and pyramid schemes.
• Handgun safety certificates.
• Illicit and recreational drugs, drug paraphernalia, drug testing equipment, or products to beat drug tests.
• Illegal or sensitive pharmaceutical products and services.
• Oils, supplements, or ingestible that are derived from or contain hemp, cannabidiol (CBD), THC, or otherwise related to cannabis.
• Medical procedures and research.
• Tobacco or tobacco-related products, including e-cigarettes.
• Knives (except for kitchen knives, cutlery, and general multi-purpose camping knives).
• Lethal and non-lethal weapon sales, including guns, gun parts, kits, mace, black powder, and ammunition.
• Loyalty/affinity/rewards and related content.
• Malware, scareware, or spyware.
• Military recruitment.
• Online pharmacies.
• Pre-natal gender selection and determination test products and services.
• Premium pay-per-call services
• Products, services, technology, or website content that i) infringes, encourages or enables the infringement of the intellectual property or personal rights of others, or ii) promotes any illegal or dangerous activity, including false document services, counterfeit designer goods, cable descramblers, fireworks, or websites that promote hacking or evading law enforcement.
• Psychics and related content.
• Religious or spiritual services.
• Short-term high-interest loans with a repayment period under 12 months and an APR of more than 50%.
• Tattooing and body branding.
• Ticket resellers (Australia only).
• UV tanning services and equipment.
• Weapons, Ammunition or Explosive.
